Separating the Combined Affirmative Action Cases

Supreme Court to hear Harvard, UNC affirmative action challenges in October

The Supreme Court will hear oral arguments in two cases on Oct. 31 that aim to ban colleges and universities from considering race in their admissions processes, according to the docket. In Students for Fair Admissions v. Harvard, the anti-affirmative action group SFFA asked the high court to overturn its ruling in a landmark case — Grutter v. Bollinger — that has shaped college admissions policies for nearly two decades. SFFA, which represents about 20,000 students, alleges the Ivy League school intentionally discriminates against Asian American students in admissions... After previously consolidating the cases, the Supreme Court separated them last month, which means that they will be heard in separate one-hour arguments.

...Separating the cases also means that Justice Ketanji Brown Jackson, the first Black woman to serve on the high court, will get to weigh in on the lawsuit against University of North Carolina, which aims to erase the use of race in public college admissions. She has said she would recuse herself from the case involving Harvard, her alma mater, though it is unlikely to impact the case's outcome due to the conservative majority on the Supreme Court...
